Land encroachments in Council's sights
Council is working with Gympie Terrace commercial jetty lease holders to rein in business activities that have expanded on to community land.
Council staff have written to, and met with, businesses operating from the commercial jetties along the foreshore, to remind them of their lease conditions.
Council property manager Clint Irwin said the leaseholders made an important contribution to the character and vibrancy of the riverfront, but it was important they played by the rules.
“As with any other business, it’s not fair to all if some take over community land to carry on their activities,” Mr Irwin said.
“The same rules apply to commercial jetties along the foreshore as for any other business in the shire - they have to stay within their lease or permit area.
“It’s important to note that the land they’re encroaching on is designated community purposes, to be enjoyed by the public at large. It’s not intended for private businesses, and indeed such commercial use is unlawful under State legislation. This land they are co-opting is owned by the State with Council as trustee. As trustee, Council has an obligation to ensure activities on the land adhere to the legislated purpose as Recreation Reserve.”
Mr Irwin said Council had talked through the issues with the jetty leaseholders. All had agreed to move their hire equipment, watercraft and other equipment such as tables and chairs, back inside their lease areas.
“Those have been productive discussions and the leaseholders agree with Council’s efforts to ensure a level playing field for all Gympie Terrace businesses,” Mr Irwin said.
“Council officers will start a compliance program from next week, but I am confident the majority of businesses will do the right thing.”
